These Terms and Conditions ("Terms") constitute a legally binding agreement between Bihar Digital Data and Network ("BDDN", "we", "us", or "our"), a digital agency based in Darbhanga, Bihar, India, and you ("User", "Client", or "you"), governing your access to and use of our website at https://bddn.online and any services offered therein.

BDDN is a professional digital agency offering the following services to businesses and individuals in India, primarily in Darbhanga and Bihar:

All services are subject to project scope, requirements confirmed between BDDN and the Client, and availability. BDDN reserves the right to modify, discontinue, or update any service at any time.

*Prices are indicative. Final pricing depends on specific project requirements. Domain and hosting charges are additional unless explicitly stated otherwise in your service agreement.

To use our website and engage BDDN's services, you must:

When using our website or engaging our services, you agree to:

• ✓Provide necessary content: For website projects, supply required content (text, images, logo files, brand assets) within agreed timelines. Delays in content delivery may impact project delivery timelines.
• ✓Respect intellectual property: Ensure that any content, images, or materials you provide to BDDN for use in your project do not infringe upon third-party copyrights, trademarks, or other intellectual property rights.
• ✓Use the website lawfully: Access and use bddn.online only for lawful purposes consistent with these Terms.
• ✓Maintain account security: If BDDN provides you with access credentials (e.g., for a hosting control panel or CMS), keep them confidential and notify us immediately of any unauthorized access.
• ✓Pay agreed fees: Pay service fees as agreed in the applicable service quotation or agreement, within the timelines stipulated.

You agree NOT to engage in any of the following activities on or in connection with our website or services:

Violation of any prohibited activity may result in immediate termination of services and may be reported to the appropriate legal authorities.

6.1 BDDN's Intellectual Property

All content on bddn.online, including but not limited to text, graphics, logos (BDDN logo), design, code (HTML, CSS, JavaScript), blog articles, service descriptions, pricing information, and structural layout, is the intellectual property of Bihar Digital Data and Network (BDDN) and is protected under applicable Indian and international copyright and trademark laws.

You may not:

• ✓Copy, reproduce, or republish our blog articles, service content, or website design without written permission
• ✓Use the BDDN name, logo, or branding in any manner without our prior written consent
• ✓Create derivative works based on our website's code or design

6.2 Ownership of Client Deliverables

Upon receipt of full payment for a project, BDDN grants the Client a perpetual, non-exclusive licence to use the delivered website, logo, or other creative assets for the purposes for which they were commissioned.

• ✓The Client owns the final delivered website code and design upon full payment.
• ✓BDDN retains the right to showcase completed work in our portfolio and use it for promotional purposes unless the Client explicitly requests confidentiality in writing.
• ✓Third-party resources (stock images, fonts, plugins) used in client projects remain subject to their respective third-party licences.
• ✓If a project is cancelled before completion, BDDN retains ownership of all work produced up to that point.

6.3 Client-Provided Content

You warrant that any content, images, text, logos, or other materials you provide to BDDN for your project are either owned by you or you have the necessary licences and rights to use them. BDDN is not responsible for any third-party intellectual property infringement arising from Client-provided content.

When BDDN undertakes a project for you, the following conditions apply:

• ✓7-Day Delivery Promise: BDDN targets website delivery within 7 working days for standard projects. This timeline is contingent on timely receipt of all required content and materials from the Client, and payment of the agreed advance/deposit. Delays caused by the Client do not constitute a breach by BDDN.
• ✓Project Scope: The scope of each project will be defined in a quotation or scope document communicated via WhatsApp or email. Any additions to the agreed scope may result in additional charges.
• ✓Revisions: A reasonable number of revision rounds are included as agreed in your project proposal. Excessive revision requests beyond the agreed scope may be billed additionally.
• ✓Hosting & Domain: BDDN may assist with domain registration and hosting setup. However, third-party hosting and domain renewal costs are the Client's responsibility after the initial complimentary period (if applicable).
• ✓Support Period: 1-year free technical support covers minor updates and bug fixes related to BDDN's delivered work. New feature development or major redesigns after project delivery are not covered under this support and will be quoted separately.

8.1 Pricing

Prices displayed on bddn.online (₹699*, ₹2,999*, ₹14,999*) are starting prices and indicative only. The actual project cost will be confirmed in a written quotation. All prices are in Indian Rupees (INR) and are exclusive of GST unless stated otherwise. Domain and hosting charges are additional unless explicitly included in your package.

8.2 Payment & Refund Policy Matrix

BDDN is not liable for any loss, damage, or inconvenience arising from your interaction with third-party websites or services accessible through links on our website.

To the maximum extent permitted by applicable Indian law:

• ✓BDDN does not warrant that the website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• ✓BDDN does not guarantee specific business outcomes, Google rankings, sales figures, or revenue results from websites or SEO services we provide, as these depend on many factors outside our control.
• ✓The "100+ Clients Served" and "100% Satisfaction Rate" statistics displayed on our website are based on BDDN's internal client records and are provided in good faith.
• ✓Pricing displayed on the website is indicative only and subject to change. T&C Apply on all displayed prices.

To the maximum extent permitted by applicable Indian law, BDDN, its owners, team members, and associates shall not be liable for:

• ✓Any indirect, incidental, special, or consequential damages arising from your use of our website or services.
• ✓Loss of profits, data, business opportunities, goodwill, or revenue.
• ✓Damages arising from unauthorized access to or alteration of your data or transmissions.
• ✓Content accuracy or completeness issues arising from third-party content or Client-provided materials.
• ✓Interruptions to service caused by hosting outages, internet disruptions, or force majeure events.
• ✓Actions or content of third-party websites linked from bddn.online.

In all cases, BDDN's total liability to you for any cause of action arising under these Terms shall not exceed the total amount paid by you to BDDN for the specific service giving rise to the claim in the 3 months preceding the claim.

You agree to indemnify, defend, and hold harmless BDDN and its owners, team members, agents, and associates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• ✓Your violation of these Terms.
• ✓Your use of our website or services in an unauthorized or unlawful manner.
• ✓Any content or materials you provide to BDDN that infringe third-party intellectual property rights.
• ✓Any claim by a third party related to your website project that arises from Client-provided content.
• ✓Your misrepresentation of any information in the enquiry form or during service engagement.

13.1 Termination by BDDN

BDDN reserves the right to terminate or suspend access to our website or ongoing services, with or without notice, if:

• ✓You breach any provision of these Terms.
• ✓You engage in abusive, threatening, or discriminatory behaviour toward BDDN staff.
• ✓You fail to make agreed payments.
• ✓Continuing the service would violate any applicable law or regulation.
• ✓You use our services for purposes that are illegal, unethical, or harmful.

13.2 Termination by Client

You may terminate engagement with BDDN at any time by notifying us via email or WhatsApp. Upon termination of an ongoing project:

• ✓All work completed by BDDN up to the termination date will be invoiced at the agreed rate (or pro-rated from the total project value).
• ✓Advance payments already made are generally non-refundable as described in Section 8.3.
• ✓Any access credentials BDDN holds for your hosting or platforms will be transferred to you upon request and final settlement.

13.3 Effect of Termination

Upon termination, Sections relating to Intellectual Property, Limitation of Liability, Indemnification, and Governing Law shall survive and continue to be binding.

14.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

14.2 Jurisdiction

Any legal action or proceedings arising from these Terms shall be brought exclusively in the courts of Darbhanga, Bihar, India, and you consent to the personal jurisdiction of such courts.

14.3 Dispute Resolution – Negotiation First

Before initiating any formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation. Please contact us at info@bddn.online or +91 79822 29379 to raise and discuss any concerns. We aim to resolve all disputes within 15 business days of being notified.

14.4 Consumer Dispute Redressal

If you are a consumer as defined under the Consumer Protection Act, 2019, you may also approach the appropriate Consumer Disputes Redressal Commission for resolution of disputes relating to deficiency in services.

BDDN reserves the right to modify, update, or replace any part of these Terms at any time. Changes will be effective immediately upon posting the updated Terms on our website at https://bddn.online/terms-and-conditions.html.

We will update the "Last Updated" date at the top of this page when changes are made. For material changes, we will endeavour to notify active clients via WhatsApp or email where feasible.

Your continued use of our website or services after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree with the revised Terms, you must discontinue use of our services.
